- Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of services provided by
LevelPOS (referred to as “we,” “us,” “our,” or “LevelPOS”), including our point-of-sale (POS) system, online ordering, phone/call-center ordering, loyalty programs, payment processing, and integrations with third-party platforms such as DoorDash. By accessing, browsing, or using any LevelPOS services—whether directly, via a restaurant’s LevelPOS-powered system, or through third-party marketplaces—you agree to be legally bound by these Terms. If you do not agree, do not use our services.
- Our Services and Ordering Channels
LevelPOS provides POS software, hardware, online ordering, phone ordering, kitchen display systems, loyalty programs, and related services to independent restaurants (“Merchants”). Orders may be placed through:
- In-store LevelPOS terminals or handheld devices
- Online ordering websites or apps powered by LevelPOS
- Phone/call-center orders
- Third-party delivery/marketplace platforms (e.g., DoorDash)
Each channel may have separate pricing, availability, fees, and rules. When ordering through a third-party platform, that platform’s terms also apply.
- Pricing and Dual-Pricing / Cash-Discount Program
We or our Merchants may offer a dual-pricing or cash-discount program compliant with applicable law. Displayed prices may reflect a cash price; a non-cash adjustment (service fee or surcharge) may be added to credit/debit card transactions. By using a card, you expressly consent to this pricing structure. All prices are subject to change without notice.
- Payment Authorization, Tokenization, and Stored Payment Methods
Payments are processed through PCI-DSS compliant third-party processors. By completing a transaction, you authorize LevelPOS and/or the Merchant to charge your selected payment method. We may store a
tokenized (not raw card) version of your payment information for:
- Future purchases
- Phone orders
- Loyalty or subscription transactions
Tokens are encrypted, cannot be reverse-engineered into usable card data outside our secure environment, and are not stored as full card details. You may remove stored payment methods at any time by contacting the Merchant or us.
- Call-Center and Phone Orders
Phone orders may be recorded for quality assurance, training, dispute resolution, and service improvement
where permitted by applicable law. Caller ID may be used to identify returning customers, retrieve order history, and enable faster service. By calling, you consent to these practices.
- SMS Communications and Loyalty Program
By providing your mobile number, you consent to receive:
- Order confirmations, updates, and receipts
- Payment request links
- Loyalty program notifications and rewards
- Promotional or marketing messages (where legally permitted)
You may opt out of marketing/SMS at any time by replying STOP or using the provided opt-out link. Message and data rates may apply. Loyalty participation is subject to program rules.
- Delivery and Third-Party Marketplace Services (e.g., DoorDash)
Delivery may be fulfilled by the Merchant or third-party providers such as DoorDash. When ordering through DoorDash or similar platforms:
- The marketplace’s terms, fees, and policies govern the transaction
- Refunds, cancellations, and disputes must be handled through the marketplace
- LevelPOS and the Merchant are not responsible for delivery delays, driver conduct, lost orders, or third-party fees
- Refunds, Chargebacks, and Disputes
Refunds for marketplace orders are processed solely through the marketplace. Direct orders are refunded at the Merchant’s or LevelPOS’s sole discretion. Chargebacks or disputes may result in temporary account restrictions, additional verification, or permanent bans from our services.
- Equipment and System Use
Any POS hardware or software provided remains the property of LevelPOS or the Merchant and may only be used for its intended purpose. Tampering, reverse engineering, or unauthorized modifications are strictly prohibited.
- Data Accuracy and Customer Responsibilities
You are solely responsible for providing accurate contact, delivery, and payment information and for reviewing order details before submission. We are not liable for errors caused by inaccurate information you provide.
- Intellectual Property
All LevelPOS software, interfaces, logos, and content are owned by LevelPOS or its licensors. You are granted a limited, non-exclusive, revocable license to use the services for personal, non-commercial ordering purposes only. You may not copy, modify, distribute, or create derivative works.
- Prohibited Conduct
You agree not to: misuse the services, engage in fraud, attempt unauthorized access, or violate any applicable law.
- Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LEVELPOS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND MERCHANTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC TRANSACTION IN QUESTION. We provide the services “AS IS” and disclaim all warranties, express or implied.
- Modifications
We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance. We will post updates with a new “Last Updated” date.
- Governing Law and Dispute Resolution
These Terms are governed by the laws of the
State of Illinois, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Cook County, Illinois.
- Severability and Entire Agreement
If any provision is held invalid, the remainder remains in effect. These Terms constitute the entire agreement between you and LevelPOS regarding the services.
